Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Sinapsio platform and services ("Service"), operated by Sinapsio ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Sinapsio provides AI-powered voice and messaging agents that allow businesses to deploy AI receptionists and sales agents. These agents communicate with the business's own customers via phone calls and messaging channels (including WhatsApp, Instagram and Facebook Messenger) that the business connects to its account.

3. Accounts and eligibility

  • You must be at least 18 years old and able to form a binding contract to use the Service.
  • You are responsible for the accuracy of the information you provide and for keeping your credentials secure.
  • You are responsible for all activity that occurs under your account.

4. Connected channels and third-party platforms

When you connect a third-party channel (such as WhatsApp, Instagram or Facebook Messenger) to Sinapsio, you authorize us to send and receive messages on your behalf through that channel. Your use of those channels is also subject to the respective provider's terms, including Meta's Platform Terms and the WhatsApp Business Messaging Policy. You are responsible for maintaining any required accounts and permissions with those providers.

5. Your responsibilities and acceptable use

You agree not to use the Service to:

  • Send spam, unsolicited, deceptive, or unlawful messages.
  • Violate any applicable law or the terms or policies of a connected platform (including Meta and Twilio).
  • Send messages without obtaining the consent required by law from the recipients.
  • Infringe the intellectual property or privacy rights of others.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

You are solely responsible for the content your AI agents send and for obtaining appropriate consent from your customers before initiating outbound messages. Sinapsio provides opt-out mechanisms, and you must honor opt-out requests.

6. Billing and payments

Paid plans are billed through our payment processor (Mercado Pago). Fees, credits, and plan limits are described at the point of purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing with prior notice; changes do not apply to the current paid period.

7. Intellectual property

The Service, including its software, design, and content provided by us, is owned by Sinapsio and protected by intellectual property laws. You retain ownership of the content and data you provide. You grant us a limited license to process that content solely to operate and provide the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AI agents may produce inaccurate or unexpected responses; you are responsible for reviewing and configuring your agents. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Sinapsio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim shall not exceed the amounts you paid to us in the twelve months preceding the claim.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or a connected platform. Upon termination, the rights granted to you under these Terms will cease.

11. Changes to these terms

We may update these Terms from time to time. We will notify customers of significant changes via email or a notice in the dashboard. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
